Ieri pomeriggio è stato infatti revocato il ricorso di Palazzo di Città in Cassazione contro la restituzione dei suoli ai costruttori. Restituzione confermata il 21 novembre scorso dal gip Lovecchio il quale ha respinto l’istanza comunale di sospensione momentanea del possesso dei suoli alle imprese. Il Comune quindi, come chiesto dal Governo, evita lo scontro: pur di mantenere i suoli e il parco della legalità è disposto a cedere alle imprese costruttrici le volumetrie perse – o meglio i “valori immobiliari” – in altre zone della città.

Un’intesa che tutela anche lo Stato Italiano visto che è stato chiamato in causa dalla sentenza della Cedu del 20 gennaio 2009. I giudici della Corte Europea dei Diritti dell’Uomo hanno ritenuto che la misura della confisca fosse in contrasto con l’articolo 7 della Convenzione europea dei diritti dell’uomo (nulla poena sine lege, vale a dire che nessuno può essere condannato e subire una sanzione per una azione che al momento in cui fu commessa non costituisse reato ) e con il primo protocollo della convenzione che tutela la proprietà privata, bollando come “arbitraria” the penalty of confiscation.
